Have you heard of John Doe - and that is being Masculine - "Jane Doe" or "Jane
Roe" for females !!!!
What is Success. By definition, it is the favorable or
prosperous termination of attempts or endeavors. The attainment of wealth, position, honors, or the
like. Perhaps it about achieving a goal.
– certainly a relative term and good
only when the goal is a worthy one. In tinseldom,
the success or glory is not necessarily the running of film for 100 days or more.
Irrespective of the success of the film,
its participants might bask in glory is what occurs many a times !!
Tamil film ‘3’ - with claim to viral fame with its release
of ‘why this kolaveri di’ song on Internet was relased recently. Read that “3” is
a romantic film with claims to be a thriller, directed by debutant Aishwarya Dhanush, stars – Dhanush and Shruti
Haasan. Soundtrack and background score composed by debutante music director Anirudh
Ravichander in Tamil with dubbed version
in Telugu. The
film’s producers R K Productions Private
Limited filed a civil suit in the Madras
High Court, to prevent copyright infringement, and have been granted an interim
injunction, directing ISPs including
MTNL, Bharti Airtel, Aircel Cellular,
Hathway Cable and Datacom, Vodafone India,Idea Cellular, Reliance Communications and TATA
Teleservices, from infringing copyright of the Producer in the film by
communicating or duplicating or downloading and uploading it in any manner
without a proper licence, reports PTI
The interim order makes ISPs who’re just
intermediaries responsible for preventing piracy, but also for infringement of
copyright on content and would that imply preventing uploads on sites like You
Tube through ISP. So, what once guaranteed
success with millions of view in You Tube, is now sought to be prevented to
ensure that they make money.
The making of song ‘why this kolaveri di’
was initially stated to have been leaked on internet – this song became most
searched on You Tube attracting more than 20 million views with a month. The film hit the screen recently after unprecedented
hype, clever marketing techniques and claimed to be a huge blockbuster success at the initial stage. In a place where things are mostly hearsay –
the budget of the movie is stated to be in the range of 22 Crores.
Today TOI reports that the movie which was
expected to his bull’s ye at box office has bounced. The
report has it that “The movie began
with a noon show, which ran full. The next
show saw a 50% drop in the number of tickets sold. And the show after that saw
another 40% drop,” says an exhibitor, adding that the movie is running to empty
halls across the state. While Dhanush has gone on record stating that his
wife’s movie has suffered no losses, distributors from Tamil Nadu, Karnataka
and Andhra Pradesh are claiming otherwise.
Arul Pathy TA, president of the Tamil Nadu
Film Distributors Association, says distributors have complained to him of the
“heavy losses” they have incurred on buying distribution rights of the movie.
“The filmmakers managed to generate a lot of hype with the song ‘Kolaveri Di’
but the movie has not lived up to the mark,” he says. Telugu film producer and distributor Natti
Kumar, who spent Rs 6 crore on the Telugu distribution rights for the movie (
4.35 crore on the royalty and the rest on publicity and promotion material),
says he has only recovered 1.70 crore. According to reports, distributors have
lost 20 crore in Tamil Nadu, while they suffered a Rs 2 crore loss in
Karnataka. “We have approached Dhanush and his father-in-law Rajinikanth for
compensation but so far we have not received any money though they have
promised to help,” says Kumar. Meanwhile, Rajnikanth’s office issued a
statement that the superstar is not connected with the revenue generation of
the film and that the actor will not reimburse the distributors for any losses.
It is a World where Success is never
guaranteed and ‘the dream factory’ many a times turns out to be soap bubbles. Yet another one bites the dust as the movie
which was expected to rake in collection has failed many or so, is what is
being stated now.
"John Doe" for males and "Jane
Doe" or "Jane Roe" for females are used as placeholder names for
a party whose true identity is unknown or must be withheld in a legal action,
case, or discussion.A ‘John Doe’ order is basically a simple ex-parte interim
injunction with the added benefit that the Plaintiff is given liberty to add to
the array of parties, infringers who have been identified after the filing of
the suit. These orders are an exception the general rule which requires the
defendant to be identified prior to the filing of a law-suit. This order in ‘3’
issued by the Madras High Court is the
latest in a series of orders by High Courts across the country targeting ISPs
in cases of copyright infringement of either music or movies.
