Insurance Policy is a contract. In general terms, a contract is an agreement
entered into voluntarily by two or more parties, each of whom intends to create
one or more legal obligations between or among them. Those obligations agreed
upon in the contract needs to be executed upon which the contracting parties
are discharged of their obligations under it.
Most contracts would call for full and precise performance, though a
substantial performance may be acceptable under certain circumstances.
I had poured out my heart that Cricket with Pak at this
stage is incorrect and had also posted against allowing Pakistan
players in Hockey league. Some could
still say that sports needs to be delineated from politics ~ certainly not with
a Nation whose atrocities are intolerable and not at a stage when our soldiers
are treated so badly. As people are commenting there is no point in celebrating
victory of Kargil war without pressing for justice for Captain Saurabh
Kalia.
Sacrificing for the country is not a new phenomenon. Since
time immemorial, to safeguard our land and culture, the honour of our mothers,
sisters and daughters, sacrifices have been made. But Capt Saurabh Kalia was
different, he did not live enough to receive his first salary even. He was taken prisoner during the Kargil War;
his mutilated body was returned to India on June 9, 1999. His father, Dr NK Kalia, 64, a retired senior
scientist from the Council of Scientific and Industrial Research has taken the
government to court. He wants his son's
case to be raised at the International Court of Justice at The Hague .
The Nation has to care for the valiant soldiers; the issue is not only limited to Saurabh or his
men but also includes the dignity of our armed forces and the honour of our
great nation. It is a national issue. Good that the Indian Hockey Federation
decided to send back nine Pakistani players who were to have taken part in the
Hockey India League tournament; although the proximate reason cited for this
decision was the security concern arising from the Shiv Sena’s call for a
boycott of the players, it perhaps more realistically reflected the wisdom of
prudence in this time of political volatility – and of not wanting to be seen
as being excessively accommodating of Pakistani sensitivities rather more than
Indian sentiments.
Copious liberal tears are already being shed over the fact
that sporting and cultural ties between the two countries are being held
hostage to cussed politics. There are
still advocates like Mani Shankar Aiyar, Mahesh Bhatt and the like…… Nation
knows of it. Would any one of these
advocates raise a liberal voice in Pak too..
the timing of these visits also is an serious issue ~ there cannot be
game when the Nation is burning.
Hockey India (HI) did not directly bar the Pakistani
players from playing but put the onus on the franchises to release them while
saying the released players would be given full contracted amount for this
season. Mumbai Magicians were the first to say that they would be releasing
their four Pakistanis players. A news
report reads that HI and Pakistan Hockey Federation (PHF) mutually decided that
Pak players would travel back but still
would be paid ………… why ~ generally when a contract – say a sale
contract could not be executed to Government rule or change in govt Policy, and
when the performance is not executed, the contract gets annulled and there
would be no payment……….
