This Extraordinary
Gazette Notification No. 373 done on Tuesday, 19th February, 2013, Magha 30,
1934 is of great significance….. It is
no ordinary official document….. it is the Notification done by Ministry of
Water resources
S.O. 404(E) would read : Whereas the Central Govt
in exercise of the powers conferred upon it by Sec 4 of the Inter-State Water
Disputes Act 1956 [33 of 1956] had constituted by notification no. S.O. 437(E)
dt 2nd June 1990, the Cauvery Water Disputes Tribunal (CWDT) to adjudicate upon
the water dispute regarding the inter-state river Cauvery……………………….. And whereas, the Supreme Court has given its
direction on 4th Feb 2013, which reads as under………………………… that is the notification in the Gazette of
India..
The Happy news for the delta
farmers and others is that on the
directions of the Supreme Court, the Centre has notified the final award
of the Cauvery Water Disputes Tribunal (CWDT) on sharing the waters of the
Cauvery system among the basin States of Karnataka, Tamil Nadu, and Kerala and
Union territory
of Puducherry . The
“extraordinary” notification in the gazette dated February 19, 2013 says the
order takes effect on the date of publication.
The Hindu reports that the Union Water Resources Ministry is learnt to
have sought the Law Ministry’s opinion on setting up a mechanism as prescribed
by the CWDT for implementation of the final award. The Tribunal had recommended
the setting up of a Cauvery Management Board/Authority on the lines of the
Bhakra Beas Management Board for implementation of the order.
Law can only guide, administer
and punish those guilty violating the cannons of law… only the people, the
State can ensure proper following up of the Orders and hopefully things happen
on the right track………………..
