Sunset Clause !!

Evening is one among the most beautiful times !  - to those  looking at sky, the horizon provides astonishing things.   Life (not only for individuals but for Nations too) changes, sometimes remarkably – if not, how can one explain what has happened in 100 years.  In last century during World War I & II Great Britain was a big imposing empire -   a globe-spanning holding so vast that it was truthfully, and somewhat arrogantly claimed that  “the sun never sets on the British Empire.”   

                       Sunset, simply is  the point whence the  sun disappears over the horizon.  Twilight is the period between sunset and dusk.  When the sun rises or sets, its position moves tangential to the ground, and the pathway from the sun to the ground is lengthened. The colour palettes – more that of Golden yellow takes all over.  It is likely that all problems vanish or get diminished when one sees something vast and overwhelming.  There is more than a new ray of hope.  



Sunset certainly would rank one among the most beautiful fleeting weather phenomenon in a day; perhaps the other one is Sun rise. People like  them more than storms, rainbows, clear blue skies or nightscapes.  As that pathway is lengthened, sunlight has the ability to hit more molecules in the air. The sun emits electromagnetic energy, as visible light. These molecules — like oxygen and nitrogen — are thousands of times smaller than the incoming visible wavelengths from the sun. Each one of those particles scatters, or changes the direction of, the sun’s visible energy. The air molecules scatter shorter wavelengths, such as blue and purples, removing them from our line of vision. Longer wavelengths, such as orange and red, can pass more freely to the ground, giving us the iconic sunset and sunrise colors.

Sunset (or sundown) is the disappearance of the Sun at the end of the Sun path, below the horizon of the Earth (or any other astronomical object in the Solar System) due to its rotation. As viewed from everywhere on Earth, it is a phenomenon that happens approximately once every 24 hours, except in areas close to the poles.   

Those in General Insurance, especially dealing with Motor Insurance, for sure, have heard of ‘Sunset clause’ !! 

A "sunset clause" or "sunset provision" is a legal provision that specifies a date or condition after which a law, regulation, or agreement will automatically expire or cease to be effective unless renewed or extended by legislative action.  The roots of sunset provisions are laid in Roman law of the mandate but the first philosophical reference is traced in the laws of Plato. At the time of the Roman Republic, the empowerment of the Roman Senate to collect special taxes and to activate troops was limited in time and extent. Those empowerments ended before the expiration of an electoral office, such as the Proconsul. The rule Ad tempus concessa post tempus censetur denegata is translated as "what is admitted for a period will be refused after the period”.  The principle was broken when Julius Caesar became dictator for life. 

Those who have insured their vehicles are aware of ‘No Claim Bonus’ a proviso that offers discount on own damage premium for a claim-free year. When renewal of vehicle insurance is due, Insurers offer discount based on the claim free years  which now starts from 20% for one year, adding up till 50% when there are no claims in preceding 5 consecutive years of insurance, subject of course to policy being renewed within time in the same name.

 


The present All India Motor Tariff came in to being by 30th June 2022 – in earlier regimes, the discount available was even 55% & 65%.  There were a few cases of individuals enjoying benefit of NCB more than 50%.  The Sunset clause in AIMT provided that for renewals falling due between 1.7.2002 & 30.6.2003 – the entitlement of higher % of NCB will remain protected for all subsequent renewals till a claim is made under the policy, in which case NCB will go back to Nil at next renewal.  

Not sure whether there are still any individuals enjoying this ‘Sunset clause’ benefit still in Motor insurance
